TERMS AND CONDITIONS Messages: SMS Text Home

Messages: SMS Text Home (the "App") is a messaging-centered home screen launcher application published by Futureby Tech ("Futureby," "we," "us," "our"). These Terms and Conditions ("Terms") govern your download, installation, and use of the App. By using the App, you agree to these Terms. If you do not agree, please do not use the App.

ARTICLE 1 — NATURE OF THE APP

The App functions as a custom home screen launcher that puts messaging at the center of your device experience. It may replace your device's default home screen and includes features such as app icon organization, widgets, wallpapers, folders, and quick access to your SMS/MMS conversations, in addition to standard text messaging functionality.

ARTICLE 2 — ELIGIBILITY

You may use the App only if:

(a) you meet the minimum age required to use mobile messaging and launcher applications in your jurisdiction; (b) you have obtained parental or guardian consent if you are considered a minor under applicable law; and (c) you agree to use the App exclusively for lawful purposes.

ARTICLE 3 — PERMISSIONS REQUIRED

Because the App operates as both a launcher and a messaging tool, it may request the following device permissions:

(a) Default launcher / home app setting — to replace or customize your device's home screen; (b) SMS/MMS access — to send, receive, and display text messages; (c) Contacts access — to show names for messages and quick-dial shortcuts; (d) Installed applications list — to display and organize app icons on your home screen; (e) Camera/media access — to set wallpapers or attach images to messages; (f) Storage access — to save wallpapers, layout preferences, attachments, and backups; (g) Notification access — to display message alerts and badges on your home screen.

You may withdraw any of these permissions through your device settings at any time. Doing so may limit the App's launcher functionality, its messaging functionality, or both, and may require you to select a different default home screen application.

ARTICLE 4 — ACCEPTABLE USE

You agree that you will not use the App to:

(a) send unsolicited bulk messages, spam, or fraudulent content; (b) harass, threaten, impersonate, or stalk any individual or organization; (c) distribute unlawful, obscene, or rights-infringing material; (d) interfere with, disrupt, or attempt to reverse-engineer the App or your device's system settings; (e) violate any applicable telecommunications, data protection, or consumer protection law.

Violation of this Article may result in suspension or termination of your access to the App.

ARTICLE 5 — OWNERSHIP OF CONTENT AND LAYOUT

You retain full ownership of all messages, media, and files sent or received through the App, as well as your personal home screen layout, widget configuration, and wallpaper selections. Futureby Tech does not claim ownership of this content and does not routinely access your private messages. Optional backup features covering messages or layout data, where available, are governed separately by our Privacy Policy and require your consent.

ARTICLE 6 — CARRIER DEPENDENCE

The messaging functionality of the App relies on your device's SIM card and cellular or data network. Standard SMS, MMS, and data charges from your mobile carrier may apply. Futureby Tech is not responsible for carrier fees, network outages, or message delivery delays caused by conditions outside our control.

ARTICLE 7 — CHANGING LAUNCHERS

You may switch back to your device's default home screen interface or to a different launcher application at any time via your device settings. Certain layout customizations made within the App may not transfer to another launcher unless you have created a backup.

ARTICLE 8 — INTELLECTUAL PROPERTY

The App's design, source code, launcher interface, trademarks, and branding are the exclusive property of Futureby Tech or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes. You may not copy, modify, reverse-engineer, distribute, resell, or use Futureby Tech's name or branding without prior written consent.

ARTICLE 9 — THIRD-PARTY SERVICES

The App may integrate with third-party services, such as wallpaper or icon pack providers, cloud backup services, or analytics tools. These services operate under their own terms and privacy practices, which Futureby Tech does not control and is not responsible for.

ARTICLE 10 — PRIVACY

Our collection and use of your personal data, including messages, contacts, and layout preferences, is described in our separate Privacy Policy, incorporated into these Terms by reference. By using the App, you consent to those practices.

ARTICLE 11 — UPDATES AND AVAILABILITY

Futureby Tech may, at its sole discretion, release updates, modify launcher or messaging features, or temporarily suspend the App for maintenance, without prior notice. We do not guarantee uninterrupted availability of the App at all times.

ARTICLE 12 — SUSPENSION AND TERMINATION

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if we determine, in good faith, that you have violated these Terms or engaged in conduct harmful to other users or to Futureby Tech.

ARTICLE 13 — DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE APP WILL BE COMPATIBLE WITH ALL DEVICES OR OPERATE WITHOUT INTERRUPTION.

ARTICLE 14 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Futureby Tech shall not be liable for any indirect, incidental, special, or consequential damages — including loss of messages, layout data, or profits — arising from your use of the App. This limitation does not apply to liability that cannot be lawfully excluded, such as liability for death, personal injury, or fraud.

ARTICLE 15 — CHANGES TO THESE TERMS

Futureby Tech may revise these Terms periodically to reflect changes in features, practices, or applicable law. Material changes will be communicated through the App or its store listing. Continued use of the App after such changes take effect constitutes acceptance of the revised Terms.

ARTICLE 16 — GOVERNING LAW

These Terms are governed by the laws applicable to Futureby Tech's principal place of business, without regard to conflict-of-law principles.
